This Terms of Service ("Agreement") describes the terms and conditions under which you may use this website (the "Site"), operated by PowerUP Scholarship Fund, Inc., a Georgia nonprofit corporation ("PowerUP," "we," "us," or "our"). The Site contains information about PowerUP's programs, mentorship model, and fundraising activities, and allows visitors to make donations and get in touch with our team.
By accessing, browsing, and/or using the Site, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, please do not use the Site. We may update this Agreement from time to time by posting the revised terms here and updating the "last updated" date above; continued use of the Site after changes are posted constitutes your acceptance of the revised terms.
You agree to use the Site only for lawful purposes. You may not use the Site or its content to harm or threaten to harm any person or organization; to damage, disable, or interfere with the operation of the Site or any related network or system; to attempt to gain unauthorized access to any part of the Site; to introduce viruses, malware, or other harmful code; or to violate any applicable local, state, federal, or international law or regulation.
Donations made through the Site are processed by a third-party payment platform (currently Givebutter). By making a donation, you agree to that platform's own terms of service and privacy policy in addition to this Agreement. PowerUP Scholarship Fund, Inc. is a registered 501(c)(3) nonprofit organization (EIN: 82-0885331), and donations are generally tax-deductible to the extent permitted by law; please consult your own tax advisor regarding the deductibility of any specific gift. All donations are final; if you believe a donation was made in error, please contact us and we will work with you in good faith to resolve it.
PowerUP Scholarship Fund, Inc. offers an optional SMS messaging program for individuals who choose to receive text message communications. By separately opting in, you consent to receive SMS messages related to our programs, scholarship opportunities, volunteer activities, events, donations, and other organization-related communications.
Your participation in the SMS program is entirely voluntary. You are not required to consent to receive text messages in order to use our website, apply for scholarships, participate in our programs, make a donation, or otherwise interact with PowerUP Scholarship Fund, Inc.
Acceptance of these Terms of Service does not automatically enroll you in our SMS messaging program. SMS consent is collected separately through our registration form and is not a condition of using our website or services.

Your participation in our SMS messaging program is subject to these Terms of Service and our Privacy Policy.
All content on the Site — including text, graphics, logos, photos, and design elements — is owned by PowerUP or used with permission, and is protected by copyright and other intellectual property laws. You may view and share content from the Site for personal, non-commercial purposes, but you may not reproduce, redistribute, modify, or use it for commercial purposes without our prior written permission. Nothing in this Agreement limits any liability that cannot be limited under applicable law.
The Site may contain links to third-party websites, such as our donation platform, social media pages, or partner organizations. These links are provided for convenience only. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site, and linking to a site does not imply our endorsement of it.
You agree to indemnify and hold PowerUP, its officers, directors, employees, and volunteers harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of this Agreement or your misuse of the Site.
This Agreement is governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any dispute arising under this Agreement will be resolved in the state or federal courts located in Georgia.
If any provision of this Agreement is found to be invalid or unenforceable, that provision will be construed, as nearly as possible, to reflect the original intent of the parties, and the remaining provisions will remain in full force and effect.
